1. Acceptance

By accessing or using the Service, you agree to these Terms and the Privacy Policy. You must be at least 16 years old.

2. Critical Medical Disclaimer

  • The Service is NOT a medical device
  • NOT regulated by Health Canada or the FDA
  • NOT for diagnosis, monitoring, or treatment
  • NOT for clinical or emergency use
  • NOT HIPAA covered

You agree that your use of the Service is entirely at your own risk and that you remain solely responsible for all health decisions.

3. No Guarantee of Accuracy

We do NOT guarantee the accuracy, completeness, reliability, or timeliness of any data, calculations, insights, reports, or AI-generated outputs.

4. Account

You are responsible for safeguarding your credentials and all activity under your account.

5. License & Restrictions

You receive a personal, non-commercial, revocable license to use the Service.

You may not:

  • Reverse engineer, resell, or exploit the Service
  • Hack, interfere, or introduce malware
  • Misuse or attempt unauthorized access

6. Intellectual Property

All content and technology belong to My HealthTracker Pro or its licensors.

7. User Content

You grant us a limited license to use your content only to operate and improve the Service, in accordance with the Privacy Policy.

8. Third-Party Services

We are not responsible for third-party services or content.

9. No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are NOT liable for:

  • Any medical or health decisions
  • Any injury, damages, or losses
  • Any data loss
  • Any indirect or consequential damages

Our maximum total liability is the greater of $100 CAD or the amount you paid in the last 12 months.

11. Indemnification

You agree to defend and indemnify My HealthTracker Pro against any claims arising from your use of the Service.

12. Force Majeure

We are not responsible for failures caused by disasters, cyberattacks, wars, outages, or third-party failures.

13. No Class Action

To the fullest extent permitted by law, you agree that disputes will be resolved only on an individual basis and not in any class or representative action.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of Quebec and Canada. Venue is Montreal, Quebec, Canada, unless otherwise required by law.

15. Termination

We may suspend or terminate access at any time. Deleted data may be permanently lost.

16. AI Transparency

The Service uses artificial intelligence to organize and summarize information.

  • AI outputs may be incorrect, incomplete, or misleading
  • Never rely on AI for medical decisions
